188(B) - Investor Stream

 

Investor Subclass (B) requires you to have managed investments or owned a business, and to be willing to invest AUD 1.5 million in Australian State or Territory Government bonds.

 

Requirements

 

All applicants must meet the following criteria:

 

1. Nomination by a state or territory government

 

2. Invitation to apply through SkillSelect

 

3. Under 55 years of age, unless waived by the nominating state or territory

 

4. Meet the pass mark in the Business Innovation and Investment Points test (currently 65)

 

5. Have an overall successful career in business or investment

 

6. You have had business and personal net assets of at least AUD 2.25 million for the last 2 fiscal years

 

7. You must make an investment of AUD 1.5 million in Australian State or Territory bonds prior to grant of the visa

 

8. You have 3 years of experience either managing a qualifying business or "eligible investments", and have showed a high level of management skill

 

9. For at least 1 of the last 5 fiscal years, you have either:

 

- Managed a business in which you hold a 10% shareholding;

 

or

 

- Managed "eligible investments" of at least AUD 1.5 million

 

Duration and Conditions

 

This is a 4 year temporary visa. Applicants cannot renew the Investor stream visa.

188(A) - Business Innovation Stream

 

Business Innovation & Investment Subclass 188 (A) visas are for investors and business owners who wish to establish business operations in Australia. The visa is valid for 4 years. This visa is only available to applicants who are nominated by an Australian State or Territory government.

 

Requirements

 

All applicants must meet the following criteria:

 

1. Nomination by a state or territory government

 

2. Invitation to apply through SkillSelect

 

3. Under 55 years of age, unless waived by the nominating state or territory

 

4. Meet the pass mark in the Business Innovation and Investment Points test (currently 65)

 

5. Have an overall successful career in business or investment

 

6. Having net business and/or personal assets of at least AUD800,000 for the last 2 fiscal years

 

7. Annual turnover of nominated business(es) must be at least AUD500,000 for the last 2 fiscal years

 

8. Applicant and/or spouse must have an ownership in the business for at least 2 years in the last 4 years:

 

- Must hold at least 51% of ownership if the annual turnover of the business is less than AUD400,000

 

- Must hold at least 30% of ownership if the annual turnover of the business is more than AUD400,000

 

Duration and Conditions

 

This is a 4 year temporary visa. A 2-year extension is possible once you have held the subclass 188 visa for 3 years, giving you 6 years from the date of grant of the original visa.

 

Once you have established an ownership interest in an eligible Australian business or businesses, you may be eligible to apply for permanent residence through the Business Innovation & Investment (Residence) Subclass 888 visa.

BUSINESS VISAS

188(C) - Significant Investor Stream
 

This option is for people who are willing to invest at least AUD5million into complying investments in Australia and want to maintain business and investment activity in Australia.

 

Advantage: No age requirement, no English language ability requirement, no points test and relative faster processing.

 

Requirements

 

All applicants must meet the following criteria:

 

1. Nomination by a state or territory government

2. Invitation to apply through SkillSelect

3. must make a complying investment of at least AUD5 million in any of the following options, in any proportion, and hold that investment continuously for at least four years

4. Must live in Australia (in the nominating state area) for at least 160 days over four years while holding your provisional visa

 

Eligible managed funds

 

- infrastructure projects in Australia

- cash held by Australian deposit-taking institutions

- Government bonds

- bonds, equity, hybrids or other corporate debt in Australian companies and trusts listed on any Australian stock exchange

- bonds or term deposits issued by Australian financial institutions - real property in Australia

- Australian agribusiness

- annuities issued by an Australian registered life company

- loans secured by mortgages over the investments listed above derivatives used for portfolio management and non-speculative purposes (which constitute no more than 20 per cent of the total value of the managed fund)

- other managed funds that invest in the investments listed above

 

Duration and Conditions

 

Applicants are allowed to renew the visa after two years if you require more time to meet the requirements for applying for the permanent visa (subclass 888). You are allowed to renew the Significant Investor visa (i.e. 188C) twice, to give you a maximum of eight years on this provisional visa.

132 Business Talent (Permanent) Visa

 

This option is the only permanent residence visa which doesn’t require provisional residence visa.

 

There are two streams, namely:

 

A. Significant Business History: for high-calibre business owners or part-owners who want to do business in Australia

 

B. Venture Capital Entrepreneur: for people who have sourced venture capital funding from a member of the Australian Venture Capital Association Limited (AVCAL).

 

Advantage: Applicant can obtain permanent residence without  temporary visa.

 

Requirements

 

Significant Business History stream Criteria:

 

1. Aged less than 55 years of age and being nominated by state/territory government

 

2. Total net assets of at least AUD400,000 as the ownership interest in one or more qualifying businesses for least two of the four fiscal years immediately before you are invited to apply and if the qualifying business(es) was a publicly listed company, a shareholding of at least 10% of the total issued capital

 

3. Net business and personal assets of at least AUD1.5 million

 

4.Total annual turnover of at least AUD3 million in one or more of your main businesses in at least two of the four fiscal years immediately before you are invited to apply

 

5.Ownership of at least: (a) 51% of a business with turnover of less than AUD400,000 per year (b) 30% of a business with turnover of more than AUD400,000 per year, or (c) 10% of a publicly listed company

 

Venture Capital Entrepreneur stream Criteria:

 

You must have received at least AUD1 million in funding from an Australian venture capital firm.

 

The funding must be for the start-up, product commercialisation or business development of a promising high-value business idea.

 

The venture capital firm must be a member of the Australian Private Equity and Venture Capital Association Limited (AVCAL).
